### Terms of Agreement for Sellers on EmpireCoastal

**1. Introduction**
These Terms of Agreement ("Agreement") govern the relationship between sellers ("Seller," "you," or "your") and EmpireCoastal ("Platform," "we," "us," or "our") for the sale of personal items, specifically shoes, on the EmpireCoastal website. By listing items for sale, you agree to these terms.
**2. Eligibility**
To sell on EmpireCoastal, you must:
- Be at least 18 years old or have permission from a parent or guardian.
- Have the legal authority to enter into this Agreement.
- Comply with all applicable laws and regulations.
**3. Listing Your Shoes**
- **Item Description**: You agree to provide accurate, clear, and honest descriptions of the shoes you wish to sell, including condition, size, brand, and any defects.
- **Images**: All images uploaded must be of the actual item you are selling and must not include any copyright-protected images.
- **Listing Fees**: You understand that EmpireCoastal may charge listing fees, which will be outlined during the listing process.
**4. Sales Process**
- **Transaction Completion**: By listing your shoes, you agree to sell them to the buyer at the price you set, upon successful completion of the transaction.
- **Payment**: Payments will be processed through EmpireCoastal’s payment system. You agree to accept the payment method chosen by the buyer.
- **Shipping**: It is your responsibility to ship the shoes promptly after the sale is completed. You agree to provide tracking information to the buyer.
**5. Prohibited Items**
You may not list or sell:
- Counterfeit or replica shoes.
- Damaged or unsafe items that do not meet safety standards.
- Any items that violate copyright, trademark, or other intellectual property rights.
**7. Dispute Resolution**
In the event of a dispute with a buyer, you agree to engage in good faith efforts to resolve the issue directly with empirecoastal.
**8. Limitation of Liability**
EmpireCoastal is not liable for any damages resulting from transactions between buyers and sellers. You agree to indemnify and hold harmless EmpireCoastal from any claims, losses, or damages incurred in connection with your sales.
**9. Changes to Terms**
EmpireCoastal reserves the right to modify these Terms of Agreement at any time. Changes will become effective immediately upon posting on the website. Your continued use of the Platform constitutes acceptance of any modified terms.
**10. Governing Law**
This Agreement shall be governed by and construed in accordance with the laws of canada, without regard to its conflict of law principles.
